Welcome to Savefans! online buying and selling community (the "Site"). This User Agreement ("Agreement") lists the terms of the agreement between you and Savefans! for the buying and selling of tickets, and all other services that Savefans! provides (the "Services"). These terms and conditions, along with any other policies or guidelines posted on this web site, shall govern your use of this Site. Please read the terms and conditions carefully before making an offer or listing tickets for sale. Buy using this Site and/or by placing a ticket offer or listing tickets for sale on this Site, you are agreeing to the following:
If Savefans! changes this Agreement, Savefans! shall post a revised
version of this Agreement here, which shall automatically replace the
terms of this Agreement. Your continued use of the Site and the
Services following Savefans! posting of a revised Agreement will
constitute your acceptance of the revised Agreement. If you do not
agree with the terms of this Agreement or any revised version of this
Agreement, do not continue to use the Services or this Site.
SERVICES PROVIDED BY SAVEFANS!
Savefans! is a safe
and secure online ticket resale marketplace for buyers and sellers.
When fans buy or sell tickets through Savefans!, they can be assured of
a safe, secure transaction. Tickets are listed by established ticket
suppliers and brokers as well as individuals. The tickets offered
through Savefans! are owned, listed for sale and fulfilled by the party
listing the ticket (not necessarily Savefans!). Prices are determined
by offers made by buyers and accepted by sellers and reflect the true
market demand of the tickets. A ticket may be purchased at a
substantially higher or lower cost than the price printed on such
ticket.
Savefans! values its customers and offers all users the following guarantee when purchasing tickets:
Your seat location will be identical or superior to the section and row you order.
In the event tickets you order are no longer available, Savefans! reserves the right, at its discretion, to upgrade you to substitute tickets of an equal or more desirable seating location at no cost to you. More desirable tickets are defined as a closer row in the same section which you order or a closer section to the stage than you ordered. You will never be charged in excess of your offer amount.
Please inspect your
tickets carefully. If you believe your tickets are not in an equal or
greater seating location than the ones you ordered you must contact
Savefans! Customer Support at (888-326-7697) within 3 calendar days of
receiving them via Fedex. If Savefans! determines that you did not
receive identical or superior tickets in accordance with the parameters
set forth above, Savefans! will either provide you with replacement
tickets that are the same as or superior than the tickets for which you
placed an offer, or at Savefans! option and following Savefans! receipt
of the tickets from you, issue you a full refund for the cost of the
tickets, plus all service and shipping and handling fees.
Your tickets will be authentic and valid for entry.
Your tickets are guaranteed to be authentic and valid for entry. In the event a problem should arise at the venue, please call Savefans! Customer Service immediately at (888) 326-7697 for assistance. Savefans! will use its best practices to contact the venue and resolve any problems immediately and get you into the show. In the event your tickets remain invalid, Savefans! will use best faith efforts to issue you substitute tickets in an equal or more desirable seating location.
If you are unable
to contact Savefans! and/or Savefans! is unable to resolve the problem
and/or find suitable replacement tickets, you must contact Savefans! within
7 calendar days following the date of the event. Savefans! will
send you a prepaid FedEx shipping label for you to use to return the
tickets to Savefans!. Once Savefans! receives confirmation from the
venue that the tickets were invalid, Savefans! will issue you a full
refund for the cost of the tickets, plus all service and shipping and
handling fees.
Your tickets will arrive in time for the event.
If your tickets have not arrived within 3 calendar days after they were scheduled for delivery or 3 days prior to the event date you must contact Savefans! Customer Service at customerservice@savefans.com or by phone at (888) 326-7697 immediately. If you do not contact Savefans Customer Service within this required time period, the benefits of this guarantee will not be applicable.
If your tickets are
not received before the event, Savefans! will work to attempt to locate
the tickets and ensure their delivery (or attempted delivery) to you
prior to the event. If the tickets cannot be located and no delivery
attempt was made prior to the event, Savefans! will issue a full
refund, including all fees and costs of shipping and handling or
upgrade you with replacement tickets in an equal or more desirable
seating location.
You will be refunded if the event is canceled and not rescheduled.
If an event is cancelled for any reason other than an act of God (rainout, earthquake, flood, etc.), war, terrorism, strike, or lockout, Savefans! will provide a full refund for the amount that you paid for the tickets. Shipping charges are not refundable. The tickets must be received by Savefans! within 14 days of the announcement of the event cancellation. Savefans! suggests returning tickets via certified mail or using a carrier that can provide you with proof of delivery. In case of a rainout or strike for a sporting event, no refunds will be made. Savefans! will attempt to contact you with further instructions in these instances. If you have not heard from Savefans! within 48 hours of the announcement, please contact Savefans! at customerservice@savefans.com or by phone at (888) 326-7697.
If an event is postponed or rescheduled, the tickets will be honored for the rescheduled event date. There will not be a need to issue new tickets for most rescheduled events or postponements. As Savefans! is not able to recover its costs on the tickets that its sellers acquire for you, Savefans! in turn is unable to offer customers refunds on postponed or rescheduled events.
In the case that an
event is relocated to a different venue, tickets for the new venue will
be provided if necessary and a refund will not generally be given.
Exact refund and exchange policies are determined on a show by show
basis by the venues and performers. If seating is not available at the
new venue a refund will be offered.
MAKING AND ACCEPTING OFFERS REFLECT
THE PRICE OF THE TICKET
The price you pay
may be substantially higher or lower than the face value price printed
on the tickets. Tickets listed on Savefans! are owned and supplied by
numerous professional ticket suppliers and brokers as well as
individual sellers. As the sales price is determined by offers made by
buyers and accepted by sellers it will in most cases differ from the
actual price printed on the ticket. The market value price for a ticket
is quite volatile, determined by many factors including seat location,
supply and demand, date and location of event, etc. You hereby agree to
and understand this.
RETURNS
There are no
refunds, exchanges, or cancellations on any request once an offer is
accepted. This policy is in place because once you make your ticket
offer, sellers rely on such offer to secure and acquire those tickets
for you from a ticket supplier and are generally not able to recover
their cost. You may rescind your offer at any time prior to its
acceptance by a seller. Please only make a standing offer after you are
certain you want the tickets.
PRICES & SEATING
All prices are
listed in U.S. Dollars (USD) and are guaranteed after your offer has
been accepted and confirmed by a seller offering the tickets, your
credit card has been charged and your purchase is completed. Due to the
large number of tickets sellers who post tickets for sale on the Site,
Savefans! cannot be responsible for any typographical or system errors
within the inventory listed for sale. If this type of error is found
while processing your order, you will be notified of the error and,
when available, be provided with other seating choices. If the tickets
you requested are not available after offer acceptance and order
confirmation, you will be provided with the equivalent or better seats
(at Savefans! discretion), when available, at no additional cost, or
Savefans! will issue you a refund. Please check your tickets carefully
once they arrive. Please contact Savefans! Customer Care department 3
days prior to the event if you have not received your tickets or if you
have questions regarding the tickets you received. If you have not
received confirmation from Savefans! that your ticket request has been
finalized, you should not assume that your ticket request will be able
to be fulfilled. Please note that notification that Savefans! is in
receipt of your ticket offer is not an order confirmation that your
ticket request has been finalized.
PROCESSING YOUR ORDER AND CONFIRMATION
Immediately
after you submit your offer for tickets, you will receive an email
notifying you that Savefans! has received your request. You will
pre-authorize your credit card for the amount of your offer. You will
never be charged more than this amount. This does not confirm ticket
availability. It only indicates that Savefans! has received your offer
for those tickets and a seller has begun the process for securing the
requested tickets. Once the requested tickets have been secured by a
seller, your credit card is charged and you should receive an order
confirmation or link to print your tickets confirming that your request
has been finalized and a seller has purchased the tickets on your
behalf. In some instances where the physical tickets or bar code
electronic ticket is not yet available, the delivery update acts as
your confirmation until the ticket is delivered. Your order may be
finalized even if you do not receive an order confirmation, finalized
invoice or an updated status email from Savefans!. If you have not
heard from Savefans!, or have only received a confirmation that we
received your ticket request, please contact customer service at customerservice@savefans.com or by phone at (888)
326-7697 to check on your order. Never make an assumption about the
status of your order because you have not been contacted by Savefans!.
You may not cancell an order due to problems with receipt of emails.
CREDIT CARD PURCHASES
Please note that
purchases by credit card do not grant any variances from Savefans!Terms
and Conditions. You are still responsible for complying with our Terms
and Conditions. Any attempts to defraud Savefans! may result in legal
and criminal action brought against you.
The credit card will be charged in accordance with the Processing Your
Order and Confirmation section.
EVENT DATES AND TIMES
Event dates and
times printed on the face of the tickets, or in any correspondence from
Savefans!, are always subject to change. This is especially true for
sporting events that are subject to television scheduling conflicts. It
is your responsibility to check for any possible changes in date and
time. You may check with your local media or contact customer service at customerservice@savefans.com or by phone at (888)
326-7697 to ensure that you arrive at the event on the correct date and
at the correct time. You agree that Savefans! is not responsible for
changes in date or time of the event, and that refunds will not be
issued due to event dates or times being changed.
SERVICE CHARGES
The service charge
helps Savefans! recover some of the costs associated with processing
payments and securing tickets, as well as guaranteeing that every
ticket on the site is authentic. The service charge is a $5 transaction
fee for a buyer (per transaction not per ticket) and 15% of the
accepted offer price for a seller (per transaction not per ticket). You
hereby accept these service charges.
TICKET DELIVERY
All tickets shipped
will be done so via Federal Express delivery service (Standard
Overnight, 2 Day, or Express Saver) and will require a signature.
Savefans! uses Federal Express delivery services requiring signature to
ensure that your tickets arrive safely and that their location can be
tracked at any time. It is your responsibility to track your package
and to be available to accept the package. You agree to provide
Savefans! with a secure delivery location (No P.O. Boxes) and authorize
someone at that address to act as your agent in your absence to accept
delivery of the package. If you provide a delivery location other than
your credit card billing location, you hereby specifically agree to be
responsible for that delivery and the tickets once delivered to the
address you specify. You agree not to dispute such charges. Your
expected ticket arrival date is based on the actual date Savefans!
ships the order.
Please note that refusal of the package does not constitute refusal of
payment. You hereby agree that you are responsible for all ordered
tickets where an attempt has been made to deliver them or make them
available to you. You hereby agree you are responsible for all ordered
tickets even if you attempt to return them. If for any reason your
tickets are returned to Savefans!, Savefans! will try to contact you to
arrange for another delivery attempt at your expense.
If your tickets are being delivered via email, a link to print your
tickets will be sent to the email address you provided once your
tickets are confirmed by the seller.
LOST OR STOLEN TICKETS
Please treat your
tickets as cash. When you receive your tickets keep them in a safe
place. Unfortunately, tickets cannot be replaced if they are lost,
stolen, or damaged. Please note that direct sunlight and heat can
damage some tickets.
TRANSLATION POLICY
In the event that
any statement in any translated version of this Site conflicts with the
English version, the statement in the English version shall prevail.
LIMITATIONS OF LIABILITY
Savefans! is not
responsible for providing transportation or reimbursement of
travel-related expenses under any circumstances unless those items are
specifically included as part of a package. In addition, Savefans! is
not responsible for any delay causing you to arrive late or miss your
event for any reason. Any actions by Savefans! that do result in you
missing your event will be rectified with Savefans! liability not
exceeding 100% of your total purchase price. Savefans! is not
responsible for the conditions or the actions of the crowd at any event
nor is Savefans! responsible for any changes made at the venue
including, but not limited to, seating arrangements, stage set-up, or
venue conditions. If someone is sitting in your assigned seat, it is
your responsibility to ask them to move or to ask an usher to assist
you.
IN NO EVENT WILL
SAVEFANS! BE LIABLE TO YOU FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY,
INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVNUES
OR BUSINESS OPPORTUNITIES, EVEN IF SAVEFANS! HAS BEEN ADVISED OF THE
POSSIBILITY OF SUCH DAMAGES.
UNAUTHORIZED USE OF THE SITE
Any Illegal or
unauthorized use of the Site shall constitute a violation of these
Terms of Use. You do not have permission to access the Site in any way
that violates, directly or indirectly, these Terms of Use. Illegal or
unauthorized use of the Site includes, but is not limited to, using the
Site to facilitate illegal ticket sales, unauthorized framing of or
linking to the Site, or unauthorized use of any robot, spider or other
automated process on the Site.
DISPUTES
If you have a
dispute and your dispute involves an event (or a ticket for an event)
that is located in the United States, then the dispute will be governed
by the laws of the State of California without regard to its conflict
of law provisions and you consent to personal jurisdiction, and agree
to bring all actions, exclusively in state and federal courts located
in Los Angeles County, California. If you have a dispute and your
dispute involves an event (or a ticket for an event) that is located in
Canada, then the dispute will be governed by the laws of the Province
of Ontario without regard to its conflict of law provisions and you
consent to personal jurisdiction, and agree to bring all actions,
exclusively in courts located in Toronto, Ontario. If you have a
dispute regarding the Site but not regarding an event (and not
regarding a ticket for an event), then: (a) if you are accessing the
Site from the United States or any country other than Canada, then the
dispute will be governed by the laws of the State of California without
regard to its conflict of law provisions and you consent to personal
jurisdiction, and agree to bring all actions, exclusively in state and
federal courts located in Los Angeles County, California; and (b) if
you are accessing the Site from Canada, then the dispute will be
governed by the laws of the Province of Ontario without regard to its
conflict of law provisions and you consent to personal jurisdiction,
and agree to bring all actions, exclusively in courts located in
Toronto, Ontario.
INDEMNITY
You agree to
indemnify and hold Savefans! and its officers, agents, employees,
contractors and principals, harmless from any loss, liability, claim or
demand, including reasonable attorneys' fees, made by any third party
due to or arising out of your use of the Site, including also your use
of the Site to provide a link to another site or to upload content or
other information to the Site.
